OCTOBER 17, 2022 CC MINUTES A regular meeting of the City Council of the City of Fort Calhoun, Nebraska, was held in open and public session at 7:00, on Monday, October 17, 2022, at the Fort Calhoun Council Chamber, 110 S 14th St, in Fort Calhoun, Nebraska. Notice of the meeting was given in advance thereof by publication, said form of notice being a designated method for giving notice, an affidavit of publication being attached to these minutes. Advance notice of this meeting was also given to the Mayor and all Council Members. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council Members. Please note that the meeting minutes are not approved until the next regular City Council meeting. On roll call, the following Council Members answered present: Andy Bowser, John Kelly, Bob Prieksat and Nick Schuler. Mayor Robinson publicly stated to all in attendance that a current copy of the Nebraska Open Meetings Act was available for review and indicated the location of such copy in the room where the meeting was being held. Mayor Robinson led those present in the Pledge of Allegiance. With a quorum present, Mayor Robinson presided, and the clerk recorded the proceedings. The public hearing relating to AN APPLICATION FOR A CONDITIONAL USE PERMIT FOR A SINGLE-FAMILY DETACHED DWELLING ON THE CALHOUN CO ADD REPLAT 2019-1LOT 2 IN THE CITY OF FORT CALHOUN, WASHINGTON COUNTY, NEBRASKA opened at 7:04 p.m. There were no written or public comments. The public hearing closed at 7:05 p.m. Member Schuler made a motion seconded by member Prieksat to approve the conditional use permit for a single-family detached dwelling on the Calhoun Co Add Replat 2019-1, lot 2. With all members voting “Aye”, motion carried. Kelli Shaner, Post Prom Committee, requested Keno funds for post prom on March 18, 2023. Member Prieksat made a motion seconded by member Kelly to approve $3,000 in Keno funds for post prom. With all members voting “Aye”, motion carried. Member Prieksat made a motion seconded by member Schuler to approve Change Order No. 1 and Pay Application No. 1 in the amount of $155,782.93 for Steve Harris Construction for Group A of the 2022 Adams Street Corridor Project. With all members voting “Aye”, motion carried. Member Schuler made a motion seconded by member Prieksat to approve Pay Application No. 2 and Final in the amount of $8,199.10 and Certificate of Substantial Completion for Steve Harris Construction for Group A of the 2022 Adams Street Corridor Project. With all members voting “Aye”, motion carried. Council discussed the amended contract for the turnover of the Riverbend Campground water line to the city. Member Prieksat made a motion seconded by member Schuler to approve the agreement contingent on receipt of easement and revised right-of-way permit from the County. With members Kelly, Prieksat, and Schuler voting “Aye”, Bowser voting “Nay”, motion carried. Member Prieksat introduced Ordinance 798 - Authorizing Issuance of Bond Anticipation Notes, Series 2022 and made a motion to approve the first reading. Member Bowser seconded the motion. With members Bowser, Kelly, and Prieksat voting “Aye”, and member Schuler abstaining, motion carried. Member Prieksat made a motion seconded by member Kelly to close 15th Street from Court to Monroe Street on November 26th from 4:00 p.m. – 7:00 p.m. for the Annual Tree Lighting and Parade of Lights. With all members voting “Aye”, motion carried. Member Kelly made a motion seconded by member Schuler to approve $2997.82 in Keno funds for the Christmas lights for the remaining businesses in town. With all members voting “Aye”, motion carried. Member Schuler made a motion seconded by member Prieksat to approve the bid of $29,915.50 from Rock Hard Concrete for the Adams Street Plaza farmers market parking. With all members voting “Aye”, motion carried. Mayor Robinson informed the public that open burning will be Friday, October 28th through Sunday, November 13th and a burn permit will be required during this time through the Fort Calhoun Fire Department.
