City of Fort Calhoun September 27, 2022 A special meeting of the City Council of the City of Fort Calhoun, Nebraska, was called by Mayor Robinson on Tuesday, September 27, 2022. The special meeting was held in open and public session at 7:06 p.m. at the City Maintenance Shop in Fort Calhoun, Nebraska. On roll call, the following Council Members answered present: Bob Prieksat, Nick Schuler, John Kelly, and Andy Bowser. Notice of the meeting was given in advance thereof by posting at City Hall, the Post Office and Calhoun Oil, said form of notice being a designated method for giving notice, a certification of posting being attached to these minutes. Advance notice of this meeting was also given to the Mayor and all Council Members. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council Members. All proceedings hereafter shown were taken while the meeting was open to the attendance of the public. With a quorum present, the Mayor presided and the Clerk recorded the proceedings. At 7:05 p.m., Mayor Robinson stated in compliance with the provisions state statute section 13-511, it was now time to conduct the public hearing relative to hearing support, opposition, criticism, suggestions or observations of taxpayers relating to amending the 2020-2021 Budget with no change to the tax request. With there being no public comments, questions or discussion, Mayor Robinson declared the public hearing closed at 7:05 p.m. At 7:07 p.m., Mayor Robinson stated in compliance with the provisions state statute section 13-511, it is now time to conduct the public hearing relative to hearing support, opposition, criticism, suggestions or observations of taxpayers relating to amending the 2021-2022 budget with no change to the tax request. With there being no written or public comments, questions or discussion, Mayor Robinson declared the public hearing closed at 7:07 p.m. At 7:08 p.m., Mayor Robinson stated in compliance with the provisions state statute section 77-1601.02, it was now time to conduct the public hearing relative to hearing support, opposition, criticism, suggestions or observations of taxpayers relating to setting the final tax request at a different amount than the prior year tax request (levy): 2021-2022 Property Tax Request $ 544,850.00 2021 Tax Rate 0.565125 Property Tax Rate (2021-2022 Requested/2021 Valuation) 0.496194 2022-2023 Proposed Property Tax Request $ 595,820.00 Proposed 2022 Tax Rate 0.542612 With there being no public comments, questions or discussion, Mayor Robinson declared the public hearing closed at 7:08 p.m. Member Schuler introduced Ordinance 797 entitled: AN ORDINANCE AMENDING ORDINANCE NUMBER 783 OF THE CITY OF FORT CALHOUN, NEBRASKA, FOR APPROPRIATING MONEY TO PAY THE NECESSARY EXPENSES AND LIABILITIES OF THE CITY OF FORT CALHOUN, NEBRASKA FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2022. Member Schuler made a motion to waive the three readings. Member Prieksat seconded the motion. With members Bowser, Prieksat, Schuler, and Kelly voting “Aye”, motion carried. Member Schuler made a motion for final approval of Ordinance 797 and member Prieksat seconded. With members Kelly, Bowser, Prieksat, and Schuler, voting “Aye”, motion carried. Member Schuler introduced Resolution No. 2022-10 Setting the 2021-2022 personal and real property tax request at $207,407.00 for principal and interest on bonds and $337,443.00 for all other purposes, for a total of $544,850.00 and moved for its passage and adoption. Member Kelly seconded the motion. On roll call the following voted “Aye”: Schuler, Kelly, Bowser, and Prieksat. The passage and adoption of said Resolution having been concurred by most of all members of the Council, the Mayor declared the Resolution adopted and, in the presence of the Council, signed and approved the Resolution and the Clerk attested the passage and approval of the same and affixed her signature thereto. A true and complete copy of the said Resolution is as follows: WHEREAS, Nebraska Revised Statute 77-1632 and 77-1633 provides that the Governing Body of the City of Fort Calhoun passes by a majority vote a resolution or ordinance setting the tax request; and WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; NOW, THEREFORE, the Governing Body of the City of Fort Calhoun resolves that: 1. The 2022-2023 property tax request be set at: General Fund: $384,320.00 Bond Fund: $211,500.00 2. The total assessed value of property differs from last year’s total assessed value by 13.89 percent. 3. The tax rate which would levy the same amount of property taxes as last year, when multiplied by the new total assessed value of property would be 0.496194 per $100 of assessed value. 4. The City of Fort Calhoun proposes to adopt a property tax request that will cause its tax rate to be 0.542612 per $100 of assessed value. 5. Based on the proposed property tax request and changes in other revenue, the total operating budget of the City of Fort Calhoun will increase (or decrease) last year’s budget by 20.92 percent. 6. A copy of this resolution be certified and forwarded to the County Clerk on or before October 15, 2022. Motion by Schuler, seconded by Prieksat to adopt Resolution #2022-10. Member Prieksat made a motion seconded by member Schuler to approve the 1% increase to restricted funds authority. With members Prieksat, Schuler, Kelly, and Bowser voting “Aye”, motion carried. Council briefly discussed the lease amount for gun range and decided to table it for the next regular council meeting.
