City of Blair Regular Council Meeting October 11, 2022 The Mayor and City Council met in regular session in the City Council Chambers on October 11, 2022, at 7:00 PM. The following were present: Holly Hafer, Kirk Highfill, Mindy Rump, Andrew Schank, Jon Stewart, Kevin Willis, Frank Wolff. Absent: Kevin Hall. Also present were City Administrator Storm, Assistant City Administrator Barrow, Director of Public Works Schoemaker, City Attorney Solomon, Library Director Zarco, Assistant Zoning Administrator Beiermann and Chief Lager. The Mayor publicly stated to all in attendance that a current copy of the Nebraska Open Meetings Act was available for review and indicated the location of such copy posted in the room where the meeting was being held. Notice of the meeting was given in advance thereof by publication in the Enterprise or the Pilot -Tribune as shown by the affidavit of publication filed in the City Clerk's office. Notice of the meeting was simultaneously given to the Mayor and all members of the City Council, and a copy of their acknowledgement of receipt of notice and the agenda is filed in the City Clerk's office. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. Mayor Hansen called the meeting to order and made introductions at 7:00 p.m. followed by a statement of compliance with the open meetings act and Pledge of Allegiance. Consent agenda approved the following: 3a) Approval of Minutes of the September 27, 2022 meeting, 3b) Clerk report of Mayoral Action of September 27, 2022 meeting, 3c) City Department reports for September, 2022, 3d) Claims as recommended by the Finance Committee, 3e) Approve Janice LePlante as a member of the Library Board until June 30, 2026, 3f) Approve request by Susan Rupp to have on public record, a correction to the September 11, 2022 Council meeting minutes, that incorrectly listed her speaking against the Conditional Use Permit for Shane Kinnison as she was speaking in support of the permit. Council approved a Lot Split application submitted by Jackie & Troy Liebe, 13697 Country Road P16, Blair, Nebraska, for a Lot Split of Tax Lot 110 in the Northwest Quarter of Section 3, Township 18 North, Range 11 East, of the 6th P.M., Washington County, Nebraska and postponed consideration of the Final Plat application submitted by Gary R. and Diane L Wehrli 14933 Highway 91, Blair, Nebraska, for The Outskerts Subdivision, Lots 1, 2 & 3, Being A Platting of Tax Lot 49, Lying in part of the Northwest Quarter of the Southwest Quarter of Section 9, Township 18 North, Range 11 East, of the 6th P.M., Washington County, Nebraska and the Rezone application submitted by Gary R. and Diane L Wehrli, 14933 Highway 91, Blair, Nebraska, for The Outskerts Subdivision, Lots 1, 2 & 3, Being A Platting of Tax Lot 49, Lying in part of the Northwest Quarter of the Southwest Quarter of Section 9, Township 18 North, Range 11 East, of the 6th P.M., Washington County, Nebraska until the first meeting in February, 2023. Carl Lorenzen, 1094 S. 13th Ave #504 Blair NE, Committee Chair, appeared before the Mayor and City Council to provide an update on the Washington County Veterans Tribute Plaza Memorial. Council approved the request by Kelly Johnson, Blair Radio, to provide a live video stream of the city council meetings via YouTube and the city's website. Council referred the request by Bob Frahm, 1133 Park St., to discuss elimination of the sidewalk on the east side of the property located at 1106 Park St. to the Transportation Committee for further review. Resolution 2022-35 concurring with the Nebraska Department of Transportation on the award of a contract to Graham Construction for the Blair South Bypass project and authorization for the Mayor to sign the contract on behalf of the City using the State's standard contract signing process was signed and adopted. Council approved an Engineering Agreement with Houston Engineering for NDOT Waterway Rehab Project and ratified all actions of Desirae M. Solomon, our LARM representative, identified in the minutes of the Annual Members' Meeting of the League Association of Risk Management on September 14, 2022, including the election of nominees to the LARM Board of Directors. City Administrator Storm had no report. He stated there would be no action taken by the council after the Executive Session, but the public was welcome to wait in the front office until after the Executive Session. Council went into Executive Session at 7:57 p.m. to discuss possible litigation involving the City of Blair and to preserve the attorney-client privilege.
