Village of Herman Minutes of Meeting September 12, 2023 The meeting of the chairman and board of trustees of the Village of Herman, Nebraska was convened in open public session at 7:00p.m. on September 12, 2023, held at the Village Office. Notice was given in advance by posting. The meeting was called to order by Chairman Wofford at 7:00p.m. Trustees Christiansen, Hawkins & Peters were present. Motion by Hawkins, second by Christiansen to approve minutes of August 8, 2023. Roll call, all ayes, motion carried. Motion by Christiansen, second by Hawkins to approve the July 31, 2023 treasurer’s report. Roll call, all ayes, motion carried. Motion by Peters, second by Hawkins to approve the bills as presented. Time: 7:11p.m. Matt Munderloh, Village Attorney was present. He stated prior to the meeting he had reviewed exhibits 1-6 with the resident of 205 E 5 th St and asked his permission to give to Chairman Wofford, Hearing Officer. Resident had no objection. Munderloh stated there was no additional testimony at this time. Hearing closed. Time: 7:39p.m. Motion by Peters, second by Hawkins to go into closed session to consult with village council regarding the appeal hearing: determination of public nuisance at 205 E 5 th Street and to review the application received for the Clerk’s position. Roll call, all ayes, motion carried. Time: 7:40p.m. Chairman Wofford stated the board will go into closed session to consult with village council regarding the appeal hearing and to review the application received for the Clerk’s position. Motion by Hawkins, second by Dean to come out of closed session. Roll call, all ayes, motion carried. Time: 8:14p.m. Munderloh stated Chairman Wofford would need to send Mijares notice within 5 days regarding the decision. Motion by Peters, second by Dean to approve Ed Schroeder preparing the audit wavier. Roll call, all ayes, motion carried. Chairman Wofford opened public hearing for FY 2023-2024 Budget. Time: 8:22p.m. He asked if there were any comments or questions from the public. There being no comments or questions, Chairman Wofford closed the public hearing. Time: 8:23p.m. Motion Peters, second by Hawkins to approve the 2024 final levy. Roll call, all ayes, motion carried. Motion by Peters, second by Dean to approve the 2023-2024 budget. Roll call all ayes, motion carried. Motion by Hawkins, second by Dean to approve the .45% property tax increase. Roll call, all ayes, motion carried. Motion by Peters, second by Hawkins to approve the 1% in restricted funds. Roll call, all ayes, motion carried. Peters introduced Resolution 2023-5 approving the signing of the Municipal Annual Certification of Program Compliance for 2023. Motion by Hawkins, seconded by Dean to adopt Resolution 2023-5 as presented. Chairman called for the roll call, all ayes. Nays – none. Chairman declared foregoing resolution passed and approve this 12th day of September, 2023. (Chairman Wofford & Trustees Dean, Hawkins & Peters signed Resolution 2023-5 at this time.) At this time the Chairman Wofford signed the Municipal Annual Certification of Program Compliance to Nebraska Board of Public Roads Classification and Standards 2023. Chairman Wofford opened the public hearing for the One & Six Year Plan. Time: 8:33p.m. Chairman asks if there were any comments or questions from the public. There being none, Chairman Wofford closed the public hearing. Time: 8:34p.m. Trustee Hawkins introduced Resolution 2023-6, a resolution whereas the Village Street Superintendent has prepared and presented the One Year and Six Year Plan for Street Minutes of September 12, 2023 Improvement Program for the Village of Herman and a public meeting was held on September 12, 2023 to present the plan. Trustee Dean moved for its adoption, seconded by Trustee Peters. Chairman called for the roll call, all ayes. Nays – none. Chairman Wofford declared foregoing resolution passed and approve this 12th day of September, 2023. (Chairman Wofford signed Resolution 2023-5 at this time.)
