City of Blair Regular Council Meeting April 11, 2023 The Mayor and City Council met in regular session in the City Council Chambers on April 11, 2023, at 7:00 PM. The following were present: Katelyn Ferrari, Holly Hafer, Kirk Highfill, Rick Paulsen, Jim Sandvold, Andrew Schank, Kevin Willis, Frank Wolff. Also present were City Administrator Storm, Assistant City Administrator Barrow, Director of Public Works Schoemaker, City Attorney Solomon, Library Director Zarco and Chief Lager. Mayor Rump called the meeting to order at 7:00 p.m. followed by roll call and the Pledge of Allegiance. Consent agenda approved the following: 4a) Approval of Minutes of the March 28, 2023, meeting, 4b) Clerk report of Mayoral Action of March 28, 2023, meeting, 4c) City Department reports for March 2023, and 4d) Claims as recommended by the Finance Committee. Resolution No. 2023-9 approving the appointment of Philip Green and the City Administrator Employee Agreement was adopted. The Council received and placed on file the audit for year ended September 30, 2022. Angie Schroder, 10364 Co Rd 29, appeared before the Mayor and City Council for approval of painted murals in the downtown area along with funding by the city for supplies for the project and Council referred to the Finance Committee for further review. Edward Matthews, 739 N. 16th St., appeared before the Mayor and City Council to present information and ask questions regarding the city's adoption of the 2018 ICC Building Codes and Mayor Rump referred the questions to City Staff for further review. Council approved the following: Ordinance 2499 rezoning Rock Haven Subdivision, located in the West ½ of the Northeast ¼ of Section 9, Township 18 North, Range 11 East of the 6th P.M., Washington County, Nebraska, to change the zoning from AGG - General Agricultural District – to RRE – Rural Residential Estates district; Conditional Use Permit submitted by Von Loh Development, Justin Von Loh, 1626 Washington Street, Blair, Nebraska, on Lot 25, Block 37, City of Blair, Washington County, Nebraska (1626 Washington St) for a single apartment on the second floor of the downtown business building for 10 years; Replat application submitted by Von Loh Development, Justin Von Loh, 1626 Washington Street, Blair, Nebraska, for the Elk Ridge Subdivision Replat 1, Lots 1 through 30 Inclusive, Being a Replat of Elk Ridge Subdivision, Lots 1 Through 38, Lying in the North 1/2 of the Northwest 1/4 of Section 7, Township 18 North, Range 12 East of the P.M., Washington County, Nebraska; Ordinance 2500 vacating and abandoning Garfield Loop right of way adjacent to Lots 1 through 18 in Elk Ridge Subdivision and Garfield Circle right of way adjacent to Lots 19 through 18 in Elk Ridge Subdivision due to replatting of Elk Ridge Subdivision; Ordinance 2501 repealing Ordinance 2495 that created Paving District No. 205 - Elk Ridge Subdivision; Ordinance 2502 creating Paving District No. 205 - Elk Ridge Subdivision; Resolution 2023-10 repealing Resolution No. 2023-1 that approved a Developer's Agreement with Justin Von Loh for the Elk Ridge Subdivision; Resolution 2023-11 approving a Developer's Agreement with Justin Von Loh for the Elk Ridge Subdivision; Engineering Agreement for the Public Improvements for Elk Ridge Development Project; awarded the bid for the 2023 Asphalt Resurfacing Project to Cather & Sons Construction in the amount of $417,291.50; material testing agreement with Olsson for the 2023 Asphalt Overlay Project in the amount of $21,850.00; a construction staking agreement amendment with JEO Engineering for the Water Treatment Plant Expansion Project; street lighting plan developed by OPPD for the Blair South Bypass and Resolution 2023-12 approving application for federal funding for the River Road Connector Trail. City Administrator Storm had no report. Council went into Executive Session at 8:11 p.m. to discuss possible litigation involving the City of Blair and to preserve the attorney-client privilege. Mayor Rump declared a motion to go into Executive Session for the limited purpose of discussing possible litigation and to preserve the attorney-client privilege has been carried. Council came out of Executive Session and reconvened as a City Council at 8:41 p.m. Mayor Rump then stated: As you may remember, the Executive Session was limited to the following subjects: to discuss possible litigation involving the City of Blair and to preserve the attorney-client privilege.
