Hayes, Deceased, real names unknown, the Estate of Shirlene A. Hayes, the Heirs, Legatees, Devisees, Personal Representatives, and all other persons interested in the Estate of Shirlene A. Hayes, Deceased, real names unknown, John Doe and Jane Doe, real names and marital status unknown. Notice is hereby given that on November 3, 2020, Kondaur Capital Corporation, not in its individual capacity but solely in its capacity as Separate Trustee of Matawin Ventures Trust Series 2020-1, as the plaintiff, filed its Amended Complaint in the District Court of Washington County, Nebraska, Case No. CI 20-186, against the Estate of Corwin F. Hayes, the Heirs, Legatees, Devisees, Personal Representatives, and all other persons interested in the Estate of Corwin F. Hayes, Deceased, real names unknown, the Estate of Shirlene A. Hayes, the Heirs, Legatees, Devisees, Personal Representatives, and all other persons interested in the Estate of Shirlene A. Hayes, Deceased, real names unknown, Vickie Lynn Cameron, Heir, Valerie L. Hayes, Heir, Cyler F. Hayes, Heir, County of Washington, Crowell Memorial Home, Mortgagee, John Doe and Jane Doe, real names and marital status unknown; the object and prayer of which is to foreclose a certain Deed of Trust on the property described as: A TRACT OF LAND COMMENCING AT THE NORTHWEST CORNER OF LOT SEVEN (7) IN BLOCK ONE HUNDRED EIGHTEEN (118) IN THE ELEVENTH ADDITION TO THE CITY OF BLAIR, THENCE EAST ALONG THE NORTH LINE OF SAID LOT 7, 140 FEET, THENCE SOUTH 60 FEET, THENCE WEST 140 FEET TO THE WEST LINE OF SAID LOT, THENCE NORTH 60 FEET TO THE PLACE OF BEGINNING. BEING THE SAME PROPERTY CONVEYED TO CORWIN F. HAYES AND SHIRLENE A. HAYES, JOINT TENANTS, BY DEED FROM BENJAMIN E. FISCHER AND ESTHER L. FISCHER, HUSBAND AND WIFE, RECORDED 10/07/1963 IN DEED BOOK 86 PAGE 353, IN THE REGISTER’S OFFICE OF WASHINGTON COUNTY, NEBRASKA, which was executed on July 28, 2011, by Corwin F. Hayes and Shirlene A. Hayes, married, as joint tenants, Trustors, and delivered to Fidelity National Title Company, a California Corp., Trustee and MetLife Home Loans, a Division of MetLife Bank, N.A., Beneficiary, and which was duly recorded on August 11, 2011 in Book 572 at Page 658 and as Instrument No. 201102898 in the Office of the Register of Deeds of Washington County, Nebraska. Such deed of trust was given to secure the payment of a certain promissory note in writing dated July 28, 2011. The plaintiff alleges in its Complaint that there is now due the plaintiff on said note the principal sum of $146,966.09, together with interest thereon. The plaintiff is the owner of the beneficial interest under such deed of trust and is the holder of the indebtedness secured thereby. The plaintiff prays that in default of payment by the defendants of the amount due the plaintiff as aforesaid, such mortgaged premises be decreed to be sold according to law to satisfy the sums found due the plaintiff, with interest and costs of suit, and that such defendants be forever barred and foreclosed of all right, title, lien, equity of redemption or other interest in, to and upon such mortgaged premises. You are required to answer such Complaint on or before the 1st day of February, 2021.
