NOTICE TO DEFENDANTS TO: Defendants Christina A. Swope, John Doe and Jane Doe, real names and marital status unknown. Notice is hereby given that on January 26, 2021, West Gate Bank, as the plaintiff, filed its Amended Complaint in the District Court of Washington County, Nebraska, Case No. CI 20-242, against Rebecca Kay Sparks, a single person, Christina A. Swope, United States of America, acting through the Rural Housing Service, Beneficiary, John Doe and Jane Doe, real names and marital status unknown, the object and prayer of which is to quiet title, reform the legal description and foreclose a certain Deed of Trust on the property described as: THE EAST 100.0 FEET OF LOT 2, BLOCK 19, IN DEXTERS 2ND ADDITION, AN ADDITION TO THE CITY OF BLAIR, AS SURVEYED, PLATTED AND RECORDED IN WASHINGTON COUNTY, NEBRASKA, TOGETHER WITH THAT PART OF VACATED STREET RIGHT OF WAY, which was executed on July 13, 2012, by Rebecca Kay Sparks, a single person, and delivered to West Gate Bank, as Trustee, and Washington County Bank, Beneficiary, and which was duly recorded on July 16, 2012, in Book 589 at Page 190 and as Instrument No. 2012-02871, in the Office of the Register of Deeds of Washington County, Nebraska. Such deed of trust was given to secure the payment of a certain note in writing dated July 13, 2012. The plaintiff alleges in its Amended Complaint that there is now due the plaintiff on said note the principal sum of $92,327.86, together with interest thereon. The plaintiff is the owner of the beneficial interest under such deed of trust and is the holder of the indebtedness secured thereby. The plaintiff prays for an Order declaring that the defendant, Christina A. Swope, has no right, title, interest or lien in the real estate described above including that part of vacated street right of way; and that the ownership in the real estate is declared quieted and cleared in the name of the defendant Rebecca Kay Sparks. The plaintiff prays for an Order providing that the legal description contained in the Warranty Deed as set for in paragraph 4 of the Amended Complaint, be reformed to read as set forth in paragraph 10 of the Amended Complaint. The plaintiff prays that in default of payment by the defendants of the amount due the plaintiff as aforesaid, such mortgaged premises be decreed to be sold according to law to satisfy the sums found due the plaintiff, with interest and costs of suit, and that such defendants be forever barred and foreclosed of all right, title, lien, equity of redemption or other interest in, to and upon such mortgaged premises.
