NOTICE OF PUBLIC HEARING ON RESOLUTION OF NECESSITY FOR 2022 OAK VALLEY ROAD CHIP SEALING PROJECT SANITARY AND IMPROVEMENT DISTRICT NO. 4 OF WASHINGTON COUNTY NEBRASKA Notice is hereby given that the Chairman and Board of Trustees of Sanitary Improvement District No. 4 of Washington County, Nebraska, will meet at 7:30 p.m. on October 3, 2022 at 9682 Oak Valley Road, Blair Nebraska, for the purpose of hearing and considering objections from owners who may become subject to assessments for the completed improvements arising from the passage of the following Resolution of Necessity proposed at this meeting relating to the 2022 Chip Sealing Project, at which meeting said Resolution of Necessity may be passed as proposed unless a Petition signed by a majority of the owners of the property which might become subject to assessments for the costs of the improvements is filed with the Clerk of the District within three days before the date of said hearing. An agenda for such meeting, kept continuously current, is available for public inspection during normal business hours at the home of the Clerk of the Board, 9612 Oak Valley Road Blair, Nebraska, which Agenda includes the consideration and passing or amending and passing of the following resolution, to-will: RESOLUTION OF NECESSITY BE IT RESOLVED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF SANITARY AND IMPROVEMENT DISTRICT NO.4 OF WASHINGTON COUNTY, NEBRASKA (HEREAFTER “DISTRICT”) Section 1. That the Chairman and Trustees deem and hereby declare it advisable and necessary to pass this resolution to repair and improve Oak Valley Road of the District, consisting of chip sealing using MC-800 asphaltic oil and 3/8” washed limestone chips and approximately 2 tons of cold mix placed prior to construction and find that said improvements will constitute a general public improvement in said District, which may properly be financed by the issuance of warrants and/or general obligation bonds of said District. Section 2. That said improvements and repairs of chip sealing including specifications and estimates of cost have heretofore been filed with the District Clerk and are hereby approved and adopted. Section 3. That to pay the cost of the improvements herein provided for, the Chairman and Trustees will, after such improvements have been completed and accepted by the district, cause to be issued warrants of the District. All the said improvements are declared to be general public improvements found and declared to be necessary and proper to maintain Oak Valley Road within the District. Section 4. That the estimate of the cost and/or the actual cost of such improvements are as follows: Chip Sealing and 2 tons of cold mix!! $9,300 TOTAL AUTHORIZED BY THIS RESOLUTION NECESSITY $9,300 The District shall cause to be levied annually a tax upon the assessed value of all of the taxable property in the District except intangible property, which shall be sufficient to meet payment of the interest and principal of the said warrants as the same become due; said tax shall be known as the Sanitary and Improvement District Tax and shall be payable annually in money. Said Resolution is contingent upon approval of the financing by the paying agent of the District. Section 5. The above Resolution is proposed this 14th day of September 2022.
