NOTICE OF CREATION STREET IMPROVEMENT DISTRICT NO. 2022-1 OF THE CITY OF FORT CALHOUN, NEBRASKA NOTICE IS HEREBY GIVEN that on August 15, 2022, the Mayor and Council of the City of Fort Calhoun, Nebraska (the “City”) passed and approved Ordinance No. 792 (the “Ordinance”) creating Street Improvement District No. 2022-1 (the “District”). The District shall encompass and include the described portions of the following streets in the City and the limits, boundaries and improvements are defined and established as follows: STREET IMPROVEMENT DISTRICT NO. 2022-1 The streets to be improved by grading, paving and related incidental work are the following described streets, including intersections: Monroe Street starting on the west side of the 16th Street intersection then west approximately 480 feet terminating in a cul-de-sac within existing right of way for Monroe Street. Which described streets are included within the boundaries of Street Improvement District No. 2022-1, which boundaries are legally described as follows: BEGINNING AT THE SOUTHWEST CORNER OF LOT 5, BLOCK 41, CITY OF FORT CALHOUN; THENCE SOUTH A DISTANCE OF 66 FEET, MORE OR LESS, TO THE NORTHWEST CORNER OF WEST MARKET SQUARE; THENCE SOUTH ON THE WEST LINE OF SAID MARKET SQUARE; A DISTANCE OF 99.5 FEET, MORE OR LESS; THENCE WEST A DISTANCE OF 66 FEET, MORE OR LESS, TO THE EAST LINE OF TAX LOT 150, THENCE WEST A DISTANCE OF 307 FEET, MORE OR LESS, TO THE EAST LINE OF TAX LOT 137; THENCE WEST A DISTANCE OF 173 FEET, MORE OR LESS, TO THE EAST LINE OF TAX LOT 143; THENCE WEST A DISTANCE OF 122 FEET, MORE OR LESS, TO THE EAST LINE OF TAX LOT 125; THENCE WEST A DISTANCE OF 82 FEET, MORE OR LESS; THENCE NORTH A DISTANCE OF 130 FEET, MORE OR LESS, TO THE SOUTH LINE OF TAX LOT 132; THENCE NORTH A DISTANCE OF 25 FEET, MORE OR LESS, TO THE SOUTH LINE OF TAX LOT 164; THENCE NORTH A DISTANCE OF 110 FEET, MORE OR LESS; THENCE EAST 62 FEET, MORE OR LESS, TO THE WEST LINE OF TAX LOT 165; THENCE EAST 143.75 FEET, MORE OR LESS, TO THE EAST LINE OF SAID TAX LOT 165; THENCE EAST 113.25 FEET, MORE OR LESS, TO THE EAST LINE OF LOT 8, BLOCK 43, OF THE CITY OF FORT CALHOUN; THENCE EAST 66 FEET, MORE OR LESS, TO THE WEST LINE OF LOT 5, BLOCK 42 OF SAID CITY OF FORT CALHOUN; THENCE EAST 299 FEET, MORE OR LESS, TO THE EAST LINE OF LOT 8 OF SAID BLOCK 42; THENCE EAST 66 FEET TO THE WEST LINE OF LOT 5, BLOCK 41 OF SAID CITY OF FORT CALHOUN; THENCE SOUTH ON SAID WEST LINE OF LOT 5, A DISTANCE OF 99.50 FEET TO THE PONT OF BEGINNING. The improvements shall be made at public cost, but special assessments on the properties specially benefited thereby may be levied to reimburse the City to the extent provided by law. If the owners of record title at the time the Ordinance was adopted representing more than 50% of the front footage of the property directly abutting any streets, avenues or alleys to be improved in the District shall file with the Clerk within 20 days after the first publication of this notice written objections to the creation of the District, such improvements shall not be made in the District. If sufficient objections are not filed against the District in the manner and time provided, the Mayor and Council shall forthwith proceed to construct the proposed improvements in the District as provided in the Ordinance.
